Acceptance
By installing or using CPWHM, you agree to these Terms of Service.
The owner and developer of CPWHM determines when a security patch needs to be sent out, and what it contains. By using CPWHM you agree that such security patches will be delivered under the mandatory-update terms below.
You are not required to cancel at any time. You may simply stop using CPWHM until you feel it is safe, or stop using it entirely, with no penalty.
Cancellation and license deactivation is only for users who are unhappy with these security policies and want out. If you do not agree to these terms, you do not need the software: you may cancel, deactivate your license, and trade it back in for a refund of half of what you paid (for example, if you paid $199.69, you receive $99.84), and discontinue use.
The company will honor its commitments in these Terms for the lifetime of the product. Honoring these commitments requires that the owner and developer be able to push security fixes through — or any issue the developer deems a security issue — regardless of user settings or objections from any party, on any panel that accepted these terms. The trade-in, security-patch, and agreement-by-use provisions are standing commitments that persist as long as CPWHM exists.
Security update authority. The owner and developer of CPWHM determines when a security patch, or any issue the developer deems a security issue, needs to be sent out, no matter what it contains. Such an update installs on any panel that accepted these terms, even if automatic updates are turned off.
Your choice, restated plainly. If you do not want these forced security updates, you may stop using the software at any time, or trade your license back in for half of your money (half of your purchase price ($99.84 on a $199.69 license)).
Mandatory Updates
We (the developer and owner of CPWHM) may deliver updates to your panel. Bug fixes, minor updates, minor feature additions, and any update we classify as a security update are mandatory: they install even if you have turned automatic updates off.
A mandatory update includes, at our sole discretion, anything we classify as addressing a security issue. Our classification is final and may include changes delivered as a beta or a feature upgrade where we determine they are necessary to protect the security, stability, or integrity of CPWHM, its users, or the hosting environment.
Before any mandatory update is applied:
- We take a backup of your panel so the change can be rolled back.
- Every update is cryptographically signed, and your panel verifies the signature before installing, so only updates issued by us can be applied.
Your panel displays a notice when a mandatory update is installed.
Once you are on a given major version (for example 3.x), all point and minor updates within that version (such as 3.1, 3.2, and beta releases within that version) are mandatory and will be installed under the mandatory-update terms above. Staying on a major version means accepting its ongoing minor and beta updates.
Optional Major Upgrades
A full half-step version upgrade (for example, from 3.0 to 3.5) is optional. You choose whether to install it. However, if you decline a half-step version upgrade, your panel will no longer be covered by our support until you upgrade.
Outdated Installations
If you refuse to upgrade, we are not responsible for what happens to your software. We do not maintain older editions for more than 30 days. There is a $199.69 buy-in fee and lifetime upgrades. Accounts that keep the old edition get 30 days of support; after that they can reach us by fax or by starting a support ticket. Support requests from holders of an older license are not a priority. We take care of our customers that are willing to grow with us.
